Generally speaking, anyone who stands to inherit the deceased person's estate is eligible to file a wrongful death suit in Nevada. This is typically a spouse, child, parent or other relative.

What damages could I receive in a wrongful death lawsuit?

Families can receive compensation for a variety of things, including insurance benefits and lost wages, medical expenses and funeral expenses. You can also receive compensation for the emotional damage and distress that you have suffered.

How long do I have to file a wrongful death lawsuit?

In Nevada, the statute of limitations for filing a wrongful death suit is two years from when your family member passed. However, if this is something you would like to pursue we advise discussing it with an attorney well before that time.

Does a wrongful death lawsuit take the place of a criminal case?

No. If a criminal act was involved in your loved one's death, the criminal case can take place at the same time as a wrongful death lawsuit, which is a civil action. You do not have to wait for the outcome of a criminal case in order to file a wrongful death lawsuit.
